Throughout these Terms, “First Choice Consolidation Group,” “FCCG,” “Company,” “we,” “us,” and “our” refer to First Choice Consolidation Group, Inc.
By accessing or using the Site, submitting information through the Site, clicking a button or checkbox indicating acceptance, or otherwise interacting with the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.
IMPORTANT NOTICE REGARDING DISPUTE RESOLUTION
PLEASE READ THIS SECTION CAREFULLY. THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT, A CLASS ACTION WAIVER, AND A WAIVER OF THE RIGHT TO PARTICIPATE IN ANY CLASS, COLLECTIVE, MASS, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE ACTION OR PROCEEDING. EXCEPT AS EXPRESSLY PROVIDED BELOW, YOU AND FCCG AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS, AND NOT IN COURT OR BEFORE A JURY.
1. Eligibility
The Site is intended only for individuals who are at least eighteen (18) years old, reside in the United States, and are legally able to enter into binding contracts. By using the Site, you represent and warrant that you satisfy these requirements.
2. Nature of FCCG’s Role and Services
FCCG is not a lender, creditor, bank, broker, servicer, legal services provider, or financial decision-maker, and FCCG does not make loans, extend credit, issue approvals or denials, guarantee approval, guarantee funding, guarantee rates or terms, or guarantee that any particular provider, product, or service will be available to you. FCCG provides marketing, advertising, lead generation, referral, administrative, and technology-enabled matching services that may connect consumers with third-party financial service providers and other service providers, depending on a consumer’s profile, location, and available products or services.
Except to the extent required by applicable law, FCCG is not your agent and is not the agent of any provider. FCCG’s role is limited to facilitating inquiries, transmitting information, and helping connect consumers with potential providers or service options.
Any form, questionnaire, or information you submit through the Site is not an application for credit or any specific financial product or service. Rather, it is an inquiry that may be used to evaluate whether you may be matched with FCCG and/or one or more third-party providers that may be able to present information, options, or conditional offers.
Submitting information through the Site does not guarantee that you will receive any offer, product, or service; does not create a lender-borrower, creditor-debtor, attorney-client, fiduciary, advisory, or servicing relationship with FCCG; does not obligate you to accept any offer; and may result in your information being shared with third-party providers, vendors, service partners, and affiliates as described in our Privacy Policy.
All third-party providers are solely responsible for their own products, services, underwriting decisions, approvals, denials, offers, disclosures, agreements, performance, and compliance obligations. FCCG is not responsible for, and disclaims liability arising from, your dealings, communications, transactions, or disputes with any provider.
3. Independent Judgment; No Advice
The content on this Site is for general informational and marketing purposes only. FCCG does not provide legal, tax, accounting, financial planning, investment, or other professional advice through the Site. You agree that you will rely on your own judgment, and where appropriate your own independent advisors, in deciding whether any provider, offer, product, or service is suitable for your needs and circumstances.
4. Accuracy of Information You Provide
You agree that all information you submit to us is true, accurate, current, and complete, and that you will promptly update information as needed. If you provide information that is false, inaccurate, misleading, outdated, or incomplete, we may deny, suspend, or terminate your access to the Site or any related services or referrals.
5. Permitted Use
You may use the Site only for lawful, personal, and non-commercial purposes. You agree not to use the Site in violation of any applicable law, impersonate any person or entity or misrepresent your identity, interfere with or disrupt the Site or its servers, attempt to gain unauthorized access to any part of the Site, upload or transmit malware or harmful material, copy, scrape, monitor, frame, mirror, or reproduce Site content through automated means without our prior written consent, or use the Site to harass, defame, abuse, threaten, or violate the rights of others. We may suspend or terminate access to the Site at any time for any lawful reason.
6. Communications; Calls; Text Messages
By providing your contact information through the Site, you expressly request that FCCG and, where applicable, providers, vendors, service partners, and affiliates with whom you may be matched contact you regarding your inquiry, including by phone call, text message, email, and prerecorded or artificial voice messages, subject to applicable law and any consent language presented at the time of submission.
Your consent is not required as a condition of purchasing any goods or services. Message and data rates may apply. You may opt out of text messages by replying STOP in accordance with the applicable message instructions. You may opt out of marketing emails by using the unsubscribe link where available. You agree that if you wish to stop communications from a specific third-party provider, you may need to notify that provider directly, and FCCG is not responsible for a provider’s failure to follow your or our stop-contact instructions.
7. Monitoring and Recording
You agree that calls with FCCG may be monitored or recorded for quality assurance, training, compliance, dispute resolution, and other lawful business purposes, subject to applicable law.
8. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Third-Party Sites and Services
The Site may contain links to third-party websites, tools, platforms, or services. FCCG does not control and is not responsible for third-party content, availability, policies, products, services, terms, or practices. Your dealings with third parties are solely between you and that third party.
10. Intellectual Property
All content on the Site, including text, graphics, logos, software, design, layout, and other materials, is owned by FCCG or its licensors and is protected by applicable intellectual property laws. Subject to these Terms, FCCG grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, or exploit Site content except as expressly permitted in writing by FCCG.
11. Feedback
If you provide suggestions, feedback, ideas, or other submissions to FCCG, you grant FCCG a perpetual, irrevocable, worldwide, royalty-free right to use, copy, modify, and incorporate such feedback for any lawful purpose, without compensation to you.
12. Errors and Delays
FCCG is not responsible for any errors or delays in responding to an inquiry, referral, or form submission caused by inaccurate or incomplete information you provide, technical issues, carrier issues, internet or platform outages, failures of third-party systems, or other causes beyond FCCG’s reasonable control.
13. Disclaimer of Warranties
THE SITE AND ALL CONTENT, FEATURES, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FCCG DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR THAT THE SITE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED. FCCG DOES NOT WARRANT THAT THE SITE, CONTENT, OR ANY COMMUNICATIONS OR REFERRALS WILL RESULT IN ANY SPECIFIC OUTCOME, OFFER, APPROVAL, OR SERVICE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FCCG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, VENDORS, SERVICE PROVIDERS, LICENSORS, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, STATUTORY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, YOUR RELIANCE ON THE SITE, ANY COMMUNICATIONS OR REFERRALS, OR YOUR INTERACTIONS OR TRANSACTIONS WITH ANY THIRD-PARTY PROVIDER.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FCCG’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100), EXCEPT TO THE EXTENT A GREATER AMOUNT IS REQUIRED BY APPLICABLE LAW.
SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
15. Indemnification
You agree to defend, indemnify, and hold harmless FCCG and its officers, directors, employees, affiliates, agents, vendors, service providers, licensors, successors, and assigns from and against any claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your violation of these Terms, your misuse of the Site, your violation of any law or third-party right, or information or material you submit through the Site.
16. Non-Reliance
You acknowledge and agree that, in using the Site and entering into these Terms, you are not relying on any representation, warranty, statement, promise, or expectation that is not expressly set forth in these Terms or in any written agreement you later enter into with the applicable provider.
17. Governing Law
These Terms and any dispute relating to the Site or these Terms are governed by the Federal Arbitration Act and, to the extent state law applies, the laws of the State of California, without regard to conflict-of-law rules, except to the extent preempted or otherwise required by applicable federal law.
18. Dispute Resolution; Binding Arbitration; Class Action Waiver
Before either you or FCCG may commence arbitration or, where permitted by this Section, bring an eligible individual claim in small claims court, the party seeking relief must first send the other party a written Notice of Dispute. Your Notice of Dispute must include your full name, mailing address, email address, phone number associated with your inquiry or use of the Site, a description of the dispute, the facts supporting your claim, and the relief sought. Notices to FCCG must be sent to First Choice Consolidation Group, Inc., Attn: Legal / Dispute Notice, 1100 Town and Country Rd., Suite 1250, Orange, CA 92868, with a copy to support@myfirstchoiceplus.com. FCCG will send any Notice of Dispute to the most recent contact information you provided to us. Both parties agree to attempt in good faith to resolve the dispute informally for sixty (60) days after a complete Notice of Dispute is received. During that period, the parties may exchange information and participate in an individual settlement conference by phone, video, or other mutually agreed method. Any applicable limitations period shall be tolled during this sixty (60) day informal resolution period. Notwithstanding the foregoing, either party may seek temporary or preliminary individual injunctive relief in a court of competent jurisdiction if necessary to prevent immediate and irreparable harm.
Except as otherwise expressly stated in this Section, any dispute, claim, or controversy arising out of or relating to these Terms, your use of or access to the Site, any information you submit through the Site, communications between you and FCCG arising from your use of the Site, or the relationship between you and FCCG arising from your inquiry or interaction with the Site shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules then in effect.
If the AAA is unavailable or declines to administer the matter, the parties will confer in good faith regarding a substitute administrator. If no administrator is available to administer the dispute consistent with this Section, either party may seek relief in a court of competent jurisdiction. The arbitrator, and not any court, shall have exclusive authority to resolve disputes relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, except that a court may decide issues regarding the enforceability of the class action waiver and any claim that a waiver of public injunctive relief is unenforceable under applicable law.
The arbitration shall be conducted by a single neutral arbitrator. For consumer convenience, the arbitration may be conducted by written submissions, by telephone, by video conference, in the consumer’s county of residence, or in another mutually agreed location, as permitted by the applicable AAA rules and the arbitrator. The arbitrator may award any individual relief available in court under applicable law, including injunctive or declaratory relief where permitted on an individual basis. Each party shall bear fees as provided by the applicable AAA consumer rules and applicable law. As an alternative to arbitration, either party may bring an individual claim in small claims court if the claim qualifies and remains strictly individual, non-class, non-collective, non-consolidated, non-coordinated, non-mass, and non-representative.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND FCCG AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, CLAIMANT, CLASS MEMBER, PRIVATE ATTORNEY GENERAL, OR OTHER REPRESENTATIVE IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, MASS ACTION, CONSOLIDATED ACTION, COORDINATED ACTION, OR REPRESENTATIVE PROCEEDING. YOU AND FCCG FURTHER AGREE THAT NO ARBITRATOR OR COURT MAY CONSOLIDATE CLAIMS OF DIFFERENT PERSONS OR PRESIDE OVER ANY FORM OF CLASS, COLLECTIVE, MASS, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE PROCEEDING, EXCEPT TO THE EXTENT SUCH A WAIVER IS PROHIBITED BY LAW.
Nothing in these Terms shall be construed to waive or prohibit any right to seek public injunctive relief to the extent such a waiver is unenforceable under applicable law. If a claim for public injunctive relief cannot be arbitrated as a matter of law, that claim shall be severed and stayed or litigated in a court of competent jurisdiction, while the remainder of the parties’ claims shall proceed in arbitration to the fullest extent permitted by law.
You may opt out of this arbitration agreement by sending written notice within thirty (30) days after you first accept these Terms. Your opt-out notice must include your full name, mailing address, email address, phone number, and a clear statement that you wish to opt out of arbitration. Opt-out notices must be sent to support@myfirstchoiceplus.com or to First Choice Consolidation Group, Inc., Attn: Arbitration Opt-Out, 1100 Town and Country Rd., Suite 1250, Orange, CA 92868. If you opt out, neither you nor FCCG can require the other to arbitrate disputes otherwise covered by this Section.
If any provision of this Section is held unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect, except that if the class action waiver is found unenforceable as to a particular claim or remedy, then that claim or remedy shall proceed in court, not arbitration, to the extent required by law.
19. Changes to These Terms
We may update these Terms from time to time. Any changes will become effective when posted, unless a different effective date is stated. Your continued use of the Site after updated Terms are posted constitutes your acceptance of the updated Terms, except to the extent prohibited by law.
20. Entire Agreement
These Terms, together with the Privacy Policy and any additional disclosures or consents presented to you on the Site, constitute the entire agreement between you and FCCG regarding the Site and supersede prior discussions regarding the Site.
